User Agreement

I. Preamble

This User Agreement (hereinafter referred to as "this Agreement") is entered into between 【Shenzhen Weardu Technology Co., Ltd.】 (hereinafter referred to as "Weardu Technology") and the user/visitor (hereinafter referred to as "You") who uses the 【WiDux】 application ("this Software") services, and is legally binding.

To provide you with better services, Weardu Technology hereby specifically reminds you to carefully read and fully understand the contents of this Agreement, involving clauses that exempt or limit liability, clauses agreeing to open and use third-party services, and clauses on applicable law and dispute resolution. Important contents such as exemption or limitation of liability clauses will be highlighted in bold for your attention, and you should focus on reading them.

By using this Software, you agree to this Agreement; if you do not agree, please do not use this Software. To provide better services or due to changes in national laws and regulations, functional services, etc., Weardu Technology will revise this Agreement from time to time. The revised content constitutes an integral part of this Agreement, and it is your responsibility to regularly review changes to this Agreement. Your continued use of this Software after the publication of revised information constitutes your agreement to and acceptance of the revised content of this Agreement.

II. Software Services

2.1 This Software refers to the mobile application developed by Weardu Technology to realize auxiliary functions for Weardu AI Smart Devices. If you have purchased Weardu AI Smart Devices, you need to connect the Weardu AI Smart Device to your mobile device via 【Bluetooth】 and download the client application of this Software to use the services of this Software.

2.2 You should obtain the client application of this Software through official channels of Weardu Technology or authorized third-party channels. Weardu Technology does not recommend downloading this Software from channels other than those mentioned above, nor can it guarantee that the Software downloaded through non-official channels will run normally; you shall bear any losses incurred thereby.

2.3 As auxiliary functional software for Weardu AI Smart Devices, you can use this Software for network connection settings, local file management, device parameter adjustment, and device function assistance for adapted Weardu AI Smart Devices. When you connect this Software with Weardu AI Smart Devices via Bluetooth and start operating some functions of the Weardu AI Smart Device, it will be considered that you agree to accept these terms of service. If you do not accept these terms of service, you may not be able to use some functions of the Weardu AI Smart Device normally.

2.4 For various service contents provided by this Software, you can turn off relevant services as needed. Weardu Technology will update, adjust, and optimize this Software and related services from time to time to provide a better user experience.

2.5 You understand and accept that this Software will collect and store other information about your use of this Software and occasionally collect user feedback or send questionnaires to provide a better user experience. At the same time, some functions may involve collecting your personal information. Weardu Technology will protect your personal privacy in accordance with the law. Please refer to the 【Weardu Privacy Policy】 for details on personal information protection.

III. Usage Specifications

3.1 This Software is for your personal use only. You are responsible for your use of this Software and related services. You shall not use this Software for any illegal or prohibited purposes under this Agreement. You agree that when using this Software and services, you will not:

• (a) Attempt to interfere with others' use of this Software or services;
• (b) Attempt to damage the normal operation of this Software or maliciously distribute viruses;
• (c) Use this Software in a way that causes excessive bandwidth, data transmission, or server occupancy;
• (d) Illegally invade networks, interfere with normal functions, or steal data;
• (e) Impersonate others or misreport identity;
• (f) Directly or indirectly charge others for using the services;
• (g) Modify, decompile, or reverse engineer this Software;
• (h) Gain unauthorized access to data;
• (i) Create derivative content;
• (j) Seek commercial benefits;
• (k) Resell services to third parties;
• (l) Store or disseminate infringing information;
• (m) Other illegal or breaching acts.

IV. Intellectual Property

4.1 All rights, titles, and interests in the content and services provided by Weardu Technology on this Software belong to Weardu Technology or have been legally licensed to Weardu Technology. No part of this Software may be reproduced or distributed in any way without explicit permission.

4.2 Weardu Technology enjoys all rights allowed by laws and regulations over all data and information generated during the development and operation of this Software and related services.

4.3 You understand and accept that you will not use trademarks, URLs, website names, or other distinctive content of Weardu Technology and this Software without written permission.

V. Compensation for Breach

To the extent permitted by law, you agree to indemnify, defend, and hold Weardu Technology harmless from any liabilities, losses, claims, and expenses resulting from your violation of this Agreement, applicable laws, or infringement of third-party rights.

VI. Limitation of Liability and Disclaimers

6.1 This Software and all content and services are provided on an "as is" and "as available" basis, without any express or implied warranties, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

6.2 While Weardu Technology strives to keep the information provided on this Software accurate and up-to-date, it does not guarantee such accuracy.

6.3 Weardu Technology makes every effort to ensure its services are always accessible, but services may be interrupted due to maintenance, network failures, or other reasons. Weardu Technology does not guarantee that its services are free from vulnerabilities or viruses.

Any damages or losses arising from your use of this Software, the total liability of Weardu Technology and its partners to you shall not exceed the total amount of subscription or similar fees related to the services or functions you used.

VII. Protection of Minors

If you are under 18, you should carefully read and agree to this Agreement under the consent and guidance of your guardian before using this Software.

VIII. Protection of Wards

Your ward should use this Software and related services under your consent, guidance, and supervision. You should properly safeguard your payment information and devices.

IX. Force Majeure

Weardu Technology shall not be liable for any delays or failures in performance resulting from acts beyond its reasonable control, including but not limited to natural disasters, internet failures, or government actions.

X. Dispute Resolution and Jurisdiction

10.1 The conclusion, execution, interpretation, and dispute resolution of this Agreement shall be governed by the laws of the People's Republic of China.

10.2 The place of signing this Agreement is Longhua District, Shenzhen, Guangdong Province. Any dispute shall be settled through friendly negotiation; if negotiation fails, either party may file a lawsuit in the competent people's court at the place where the Agreement was signed.

XI. Miscellaneous

11.1 Severability. If any provision is deemed invalid, the other provisions shall remain enforceable.

11.2 Assignment. You may not assign your rights under this Agreement.

11.3 Waiver. Failure by Weardu Technology to exercise any right shall not be deemed a waiver.

11.4 Entire Agreement. This Agreement constitutes the entire agreement between you and Weardu Technology.
